Right of Withdrawal
RIGHT OF WITHDRAWAL – DISTANCE SELLING
- 1 In the event of distance selling,
The customer having the status of consumer has, in accordance with the provisions of Article L.221-18 of the Consumer Code, a period of fourteen (14) days from the conclusion of the contract, for service provision contracts or from receipt of the Product(s) for sales contracts, to notify the Establishment of his wish to exercise his right of withdrawal. For the calculation of the period, see Article L.221-19 of the Consumer Code in the Appendix. In accordance with the provisions of Article L.221-28 of the Commercial Code, the right of withdrawal cannot be exercised in particular for contracts: "For the provision of services fully performed before the end of the withdrawal period and the execution of which began after the express prior agreement of the consumer and express waiver of his right of withdrawal". By validating an order for Services whose execution is scheduled before the end of the withdrawal period, the Consumer expressly waives the right to exercise his right of withdrawal. "for the supply of goods made to the consumer's specifications or clearly personalized". Consequently, no right of withdrawal is open to the Customer for any order of any so-called "custom-made" Product, i.e. for which the Customer will specify the dimensions and characteristics himself.
- 1.1. Method of exercising the right of withdrawal
Within fourteen (14) days following the conclusion of the contract for the Services or receipt of the Product for sales, the Customer may request either the exchange or the refund of his order for the Services and/or Product(s) concerned. The Customer exercises his right of withdrawal, by means of an unambiguous declaration, for example by returning the withdrawal form provided by the Establishment and in the Appendix, by email to the address: contact@happybuyday.com, or by registered letter with acknowledgment of receipt to the address SARL HappyBuyDay - 133 chemin de Faucon - 83310 - COGOLIN, specifying the order number and the Services and/or Product(s) concerned. The Customer may not under any circumstances exercise his right of withdrawal by simply returning the Product concerned directly.
- 1.2. Product return procedures
From the exercise of the right of withdrawal, the Customer has a maximum period of fourteen (14) additional days to return, at his/her expense, the Product(s) concerned which must be returned in its/their original condition (including original packaging, accessories, any element relating to the order, etc.). The return of the Products must imperatively be accompanied by the duly completed return slip, in particular with the return number provided by the Establishment. The risks associated with the return of the Products are the responsibility of the Customer. The return costs are the responsibility of the customer. Unless otherwise advised by us, any returned Product must be sent to the following address: SARL HappyBuyDay - 133 chemin de Faucon - 83310 - COGOLIN. The Customer must keep all proof of this return allowing a specific date to be given.
- 1.3. Reimbursement
If all of the above conditions are met, the Establishment will reimburse the Customer for all amounts incurred when ordering the Service(s) and/or Product(s) concerned (the reimbursement of delivery costs is limited to the amount of the least expensive delivery method offered by the Establishment) with the exception of the return costs incurred by the Customer and, where applicable, the amount corresponding to the Services already provided until the communication of the decision to withdraw. This reimbursement will be made using the same means of payment as that used during the initial transaction, within fourteen (14) days from the date of exercising the right of withdrawal. The Establishment may defer the reimbursement until the day on which it receives the returned Products or until the Customer provides proof of shipment of the Products concerned, the date retained being that of the first of these events.
